JUSTICE SANJAY PRIYA ORAL ORDER 28-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Brahampura P.S. Case 92 of 2016 instituted for the offence under Sections 379 and 414/34 of the Indian Penal Code.

It has been submitted that charge sheet has been submitted. The petitioner is in custody since 4.5.2016. From the written report, it appears that one Tempo alleged to be stolen one, was recovered from the possession of the petitioner and one Guddu Kumar. It has been stated in the written report that the aforesaid Tempo was found painted with black colour and apprehended persons disclosed that the said tempo was stolen by them in the village Dharampur and the same belongs to Upnesh Kumar. They stated that when they had

Patna High Court Cr.Misc. No.7280 of 2017 (2) dt.28-02-2017 2/2 brought the tempo for sale in Kawadi shop, they have been apprehended by the local people and handed over to the police. The learned Sessions Judge has mentioned in the impugned order that charge sheet has already been submitted against the petitioner.

Keeping in view the period spent by the petitioner in custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sunil Kumar Tripathi, learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Brahampura P.S. Case No. 92 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
