1. The writ petition is filed to command the respondent authorities to pay a sum of Rs. 3,28,003/- towards the transportation cum delivery chaques, milling charges for the year 2014-15.

2. The brief facts of the case are that the petitioner is a Miller and the respondent BSFC has entrusted the petitioner for a total paddy of 6850.66 Quintals for the year 2014-15 against

2/4 which the firm returned 4590.00 Quintals of customed milled rice to the BSFC, Saharsa as per the norm of 67 per cent for which a bill was raised for Rs. 68,506/-. In the same year, the firm carried and delivered the paddy for a total sum of Rs. 4,01,832/- and after deduction of necessary charges a bill of Rs. 2,59,497 was passed and paid to the petitioner firm.

3. The District Manager, BSFC, Saharsa vide letter no. 139 dated 11.02.2016 requested the Head of Finance, Patna to pass the bill of Rs. 2,59,497/-. Thereafter the proprietor firm also submitted the milling bill of Rs. 68,506/- along with the bill of Rs. 2,59,497/- before the BSFC, Saharsa on 09.03.2016. The firm also has deposited an amount of Rs. 2,00,000/- towards security deposit. However, those amounts were not been paid. The petitioner made a detailed representation to the District Manager, BSFC, Saharsa for payment of the said amount, as the respondents did not pay the said amount, the petitioner was constrained to file the writ petition before this Court.

4. It is the specific contention of the Learned counsel for the petitioner that till date he has not received any payment and the representation preferred by the petitioner is still pending before the Authority.

5.Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

6. The Learned counsel for the respondents suggested that a fresh representation may be filed by the petitioner with all relevant documents to enable the respondents to pass appropriate order to the petitioner.

Considering the said fact that the representation was filed long back in the year 2016, this Court directs the petitioner to file a fresh representation along with all relevant documents within one month from the date of receipt of this order and in turn the District Manager, BSFC, Saharsa shall consider all the materials on record, on merits, in accordance with law and shall pass appropriate order within three months from the date of filing of the representation.

8. With the aforementioned observation, the writ petition stands disposed of.
