JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 392, 412 and 414 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act. The petitioner was arrested while fleeing after robbing the informant. He is in custody since 11.09.2016 and has stated on oath that he has got no criminal antecedent. Further defence of the petitioner is that, in fact, he had orally mortgaged the gold chain and taken loan from informant at 10% interest. However, the petitioner went to refund the money within 16 days of mortgaged, but the informant was claiming interest for whole month and for that dispute present false case has been lodged.

Patna High Court Cr.Misc. No.9841 of 2017 (3) dt.25-04-2017 Considering the aforesaid facts specially the period already undergone, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai/Successor Court, in connection with Begusarai Town P.S. Case No.421 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
