The petitioner seeks bail in connection with Marauna P.S. Case No.97 of 2016 registered under Sections 384, 386 and 387/34 of the Indian Penal Code.
The allegation of the informant is that the wife of the petitioner used to do the work of maid in his house. In the morning of 03.10.2016, the petitioner alongwith two others came to the house of the informant. The informant suspected that some scuffle might have taken place as earlier the petitioner had come to his house after scuffle and the matter was pacified. One person asked the informant as to whether he is known to him on which the informant replied that he does not know to him, then he told his name as Pawan Sah. The informant was well known to the activities of Pawan Sah and, thereafter, the informant came in fear but the informant starting to talk. Pawan Sah asked the informant about the whereabouts of his wife and asked the informant that the talk would be made in her presence. Then the informant called his wife and two persons alongwith the petitioner came to the bed room of the informant. Thereafter, Pawan Sah made demand of Rs.10,00,000/- from the informant. The informant showed his inability but Pawan Sah asked the informant to make arrangement of Rs.
5,00,000/- till Saptami and went outside of the house. At that time, another person snatched the nose pin and Rs.8000-9000/- from the purse of the wife of the informant and went outside of the house. Thereafter, the informant asked the petitioner as to why he has come alongwith them to his house then the petitioner told him that one day before he alongwith them had also come to his house as they had some work with him. Further allegation of the informant is that on 06.10.2016, his wife received phone regarding the payment of amount, then the wife of the informant gave Rs.
Patna High Court Cr.Misc. No.7336 of 2017 (3) dt.07-04-2017 3/3 mother of Pawan Sah. Again on that day, a phone was received by the wife of the informant making the demand of further Rs.2,00,000/-.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the wife of the petitioner used to do the work of maid at the house of the informant and he was threatened by Pawan Sah to go to the house of the informant. The petitioner having no criminal antecedent is in custody since 17.11.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Kumar Krishnadeo, Judicial Magistrate, Supaul, in connection with Marauna P.S. Case No.97 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner.
