The petitioner, who is in custody, seeks bail in connection with Jogbani P.S.Case No. 77 of 2015 registered under Sections 419, 420 and 120B of the Indian penal Code, Sections 27(b)(ii), 27(d), 28, 28-A and 36-AC of the Drugs and Cosmetics Act, 1940 and Section 22B of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Allegation in brief is that petitioner was running a drug shop in the name of his deceased father and it is alleged that some cough syrups were also being sold, which was misused. It is submitted that except the allegation that the petitioner was running a medical shop having a licence of the same in the name of his father and was selling cough syrups and

Patna High Court Cr.Misc. No.6741 of 2017 (2) dt.16-02-2017 2/2 other medicines, but there is no other allegation of involvement in any narcotic and psychotropic substance and this petitioner has been in custody since 19.12.2016.

Having considered the aforementioned facts and circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Araria in connection with Jogbani P.S.Case No. 77 of 2015 corresponding to Special Case No. 10 of 2015 with condition that he shall present before the court below on each and every date during trial and in case of failure to appear on two consecutive dates, without sufficient cause, his bail bonds shall be liable to be cancelled.
