The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Desri P.S. Case no. 197 of 2021 instituted for the offence under Sections 307, 34 of the Indian Penal Code Section 27 of Arms Act.

As per allegation in the FIR, when informant was in a marriage ceremony at his Nanihal and while he was sitting with his friends, Petitioner came there with co-accused by a bullet motorcycle and one of them fired on the informant with a view to kill him, which hit to a pillar and thereafter hit on his upper side of the waise.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.11930 of 2022(2) dt.06-09-2022 2/2 has submitted that petitioner is innocent and has committed no offence. As per injury report, injured had received lacerated would over right side of lower back and abrasion in back caused by hard and blunt object. Nature of injuries are simple. Learned APP has opposed the prayer of anticipatory bail of the petitioner.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Desri P.S. Case no. 197 of 2021, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M Vaishali (Hazipur) subject to the conditions as laid down under section 438(2) of the Cr.P.C.
