JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-03-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Gardanibagh Police Station Case No. 438 of 2014, disclosing offences under Sections 420/34 of the Indian Penal Code.
It is alleged that the petitioner and her husband purchased some cloths, worth Rs. 32,184/-, from the shop of the informant and without paying the entire amount, they took away the garments. It is said that they had paid only Rs. 1,000/- against the total amount of Rs. 32,184/-. Learned Counsel appearing on behalf of the petitioner has submitted that the husband of the present petitioner has been granted regular bail by the Court of
Patna High Court Cr.Misc. No.7572 of 2016 (2) dt.17-03-2016 2/2 learned Additional Sessions Judge XIV, Patna, with condition that he will be depositing a sum of Rs. 31,184/- in the Nazarat along with the bail bond.
Considering the fact that the petitioner's husband has been granted bail, this application is allowed. Let the petitioner, Gudiya Devi, in the event of her arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna, in connection with Gardanibagh Police Station Case No. 438 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
