The petitioner seeks bail in connection with Araria P.S. Case No. 992 of 2019, registered under Sections 143 and 414 of the Indian Penal Code.

The accusation is that in course of checking of the vehicle, informant received information that stolen motorcycle is kept by Saquib Raza, resident of village Kharaihia Basti, Araria. Thereafter, the informant, along with other police personnel, reached there, and on search of house of Saquib Raza two motorcycles were recovered, but, he did not produce any paper of both the motorcycles. On query, he disclosed that he along with Md. Ruhul Amin and Noore Nazar (petitioner) had stolen two motorcycles, one from Mahadeva Chowk and other from zero mile and both are kept for selling. He also disclosed

Patna High Court CR. MISC. No.9928 of 2020(2) dt.29-02-2020 2/2 that petitioner and Md. Ruhul Amin has also kept the stolen motorcycle, thereafter, the police reached at the house of the petitioner and recovered one motorcycle, but, on demand petitioner did not produce any paper.

Submission is that petitioner is in custody since 15.11.2019 while he is accused in two cases, as detailed in paragraph 3 of the petition, but, in both the cases he is on bail. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Araria P.S. Case No. 992 of 2019 to the satisfaction of the Chief Judicial Magistrate, Araria, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
