The present application has been filed for modification application of order dated 13.12.2022 passed in Cr. Misc. No.51720 of 2022 for modifying the condition of showing the deposit of Rs.1,51,907/- in the account of SBPDCL as the statements contradicts the other part of the said order stating the provisional bail bond of the petitioner shall be accepted by the learned court below after filing of an appeal under the Electricity Act and also to the extent of extending the period of surrender.

Considering the submissions made by the learned counsel

Patna High Court CR. MISC. No.28477 of 2023(3) dt.26-07-2023 2/2 for the petitioner, I am not inclined to make any modification in the said order.

However, on the grounds mentioned in the modification application and in the interest of justice, the period to surrender is extended by eight weeks from today in connection with Ben P.S. Case No.193 of 2021, pending in the court of learned A.C.J.M. - I, Nalanda at Bihar Sharif, subject to deposit of Rs.2000/- (Rs. Two Thousand) in the Victim Compensation Fund, Bihar.

The order dated 13.12.2022 is modified to the extent as indicated above.
