The petitioner seeks regular bail in connection with Naubatpur P.S. Case No. 430 of 2020 lodged under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the present FIR has been lodged against 8 known person in which the petitioner's named has not figured in this case, as such no offence under Section 27 of the Arms Act has been made out. He further submits that his named has figured in this case on confessional statement of accused no. 1 Sujit Kumar. He submits that petitioner is in custody since 25.08.2021, which transpired from the rejection order of Additional Sessions

Patna High Court CR. MISC. No.12222 of 2022(2) dt.29-06-2022 2/2 Judge-I, Danapur in B.P. No. 1140 of 2021. He further submits that the accused no. 1 Sujit Kumar has disclosed two names, i.e. Raju Kumar and Ranjan Kumar (present petitioner). Raju Kumar was granted bail by a Coordinate Bench of this Court vide order dated 23.06.2022 passed in Cr. Misc. No. 10331 of 2022.

Learned APP for the State opposes the prayer for bail. In the present facts and circumstances of the case that present petitioner is not named in the FIR and he is in custody since 25.08.2021, charge sheet has already been filed in this case and with a view to maintain the parity, let the petitioner above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Danapur in connection with Naubatpur P.S. Case No. 430 of 2020, subject to the conditions as laid down under Section 437(2) of the Cr.P.C. (Dr. Anshuman, J) Gautam/- U T
