Petitioner is apprehending arrest in connection with Excise Case No. 8 of 2020 for the offence under section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
In the instant case total 23.625 liters of liquor was allegedly seized from the cattle shed of the petitioner. Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner.
Considering the aforesaid, the Court is inclined to
Patna High Court CR. MISC. No.9837 of 2020(2) dt.29-02-2020 2/2 grant anticipatory bail to the petitioner, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, 2nd cum Special Judge, Excise, Samastipur, in connection with Excise Case No. 08 of 2020 subject to the condition as laid down under section 438(2) of the Cr.P.C.
