JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody since 19.10.2021 in a case registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code.

It is alleged by the informant that her four years' minor son was killed by co-accused Rakesh Baitha. It is alleged against the petitioner that the petitioner being mother of co-accused Rakesh Baitha has also conspired in the murder of the son of the informant. The petitioner and the informant are agnates and in the background of some land dispute, the present accusation has been levelled against the petitioner. The petitioner is not named in the F.I.R and only on suspicion, she has been roped in the present case. There is no eye witness to the occurrence. Moreover, the petitioner is in custody since 19.10.2021. Considering the facts stated above and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 95 of 2021.
