This application under section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 16.09.2014 passed in Sessions Trial No. 690 pf 1996 arising out of Nasugachhia P.S. Case No. 199 of 1992 by the learned 3rd Additional Sessions Judge, Naugachhia. Bhagalpur whereby the learned Judge has ordered for amendment in charge so far as the place of occurrence is concerned.
From a bare perusal of the impugned order dated 16.09.2014, it would appear that the court below has passed the order with consent of the parties as both the parties conceded that the charge of the case was defective so far as place
Patna High Court Cr.Misc. No.17995 of 2015 (3) dt.06-05-2015 2/2 of occurrence was concerned.
In that view of the matter, I do not find any merit in this case. Accordingly, it is dismissed. (Ashwani Kumar Singh, J) M.Rahman/- U T
