JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sikandara P.S. Case No. 147 of 2014 registered for the offence under Section-47(A) of the Excise Act.
Admittedly, the alleged recovery has been made from a field and the informant came to know about the name of petitioners from villagers. Petitioners do not have any criminal antecedent.
Accordingly, it is ordered that petitioners, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the
Patna High Court Cr.Misc. No.11688 of 2015 (2) dt.27-04-2015 2/2 petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Sikandara P.S. Case No. 147 of 2014 to the satisfaction of Sri A. K. Singh, Judicial MagistrateIst Class, Jamui subject to conditions as laid down u/S 438(2) of the Cr. P.C.
