Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Majhaulia P.S. Case No. 540 of 2019, registered under Section 376 of the Indian Penal Code and Sections 4 and 8 of the POCSO Act.
Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected on merit vide order dated 08.06.2020 passed in Cr. Misc. No. 4474 of
Patna High Court CR. MISC. No.22957 of 2021(2) dt.28-07-2021 2/2 2020 by this Court with observation that if the trial of the petitioner is not concluded within six months, the petitioner would be at liberty to renew his prayer for bail and now more than one year has been elapsed but the trial of the petitioner has not been concluded due to Pandemic of Covid -19. In view of the order dated 08.06.2020 passed in Criminal Misc. No. 4474 of 2020, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge POCSO, Bettiah, West Champaran, in connection with Majhaulia P.S. Case No. 540 of 2019. Out of two sureties, one surety must be the close relative of the petitioner.
