====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2026 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing for the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 120B, 328, 302, 506/34 of the Indian Penal Code.
3. Prosecution case, in brief, is that on account of money dispute, all the F.I.R. named accused persons, including this petitioner, committed murder of the son of informant by administering poison.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. From perusal of the F.I.R., it is apparent that informant is not an eye witness of the occurrence and only suspicion has been raised
Patna High Court CR. MISC. No.12484 of 2026(3) dt.14-07-2026 2/3 against the petitioner. Petitioner is presently working as Junior Commissioned Officer at Danapur Cantonment and at the relevant date and time, he was at his duty. In this regard, he relies upon a letter dated 09.07.2020 which was written by Lt. Col. of Bihar Regiment Centre C/O 56 APO to the Deputy Superintendent of Police, Phulwari Sharif wherein it is mentioned that petitioner was at Regiment Centre and was on duty with effect from 18.05.2020 till the date of issuance of letter. Furthermore, on 17.08.2020, again, a letter was issued by him in the name of City S.P. (West) Patna for removing name of the petitioner from instant F.I.R. since he was on duty on the date of occurrence (Annexures P-3 & P3/1). It is further submitted that during investigation, A.S.P., Phulwari Sharif, Patna has also found that this petitioner was not present at the place of occurrence on 02.11.2020 (Annexure-7). Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering backdrop of the case, nature of accusation, materials available on record and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender
Patna High Court CR. MISC. No.12484 of 2026(3) dt.14-07-2026 3/3 before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-cum-Additional Chief Judicial Magistrate IX, Patna in connection with Phulwari Sharif (Janipur) P. S. Case No. 340 of 2020, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
