2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8(c), 20(b) (ii) (B) of the N.D.P.S. Act.
3. The case of the prosecution is that the petitioner along with the others have cremated the body of his daughter, after killing her. The F.I.R. was filed by a local Chowkidar.
4. The learned counsel for the petitioner has submitted that during the course of the investigation it has come that it is not a case under Section 103 of the B.N.S. and Police has filed a charge sheet under Section 108 of the B.N.S. The learned counsel for the petitioner has also submitted that during the
Patna High Court CR. MISC. No.12610 of 2025(3) dt.09-05-2025 2/2 investigation, the witnesses has stated only this much that the deceased was being scolded and was slapped by the family members and the informant in the evening and in the morning she was found hanging in her room. These material does not attract abetment to suicide. The petitioner is in custody since 31.08.2024.
5. Learned APP for the State has opposed the prayer for regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bahera P.S. Case No.341 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Benipur, DistrictDarbhanga.
