JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kudra P.S. Case No. 08 of 2015 registered for the offences punishable under Sections 147, 148, 149, 323, 325, 307, 504 of the Indian Penal Code.
Considering this aspect of the matter that altogether seven persons sustained injures in the alleged occurrence and the counter case establishes this fact that an altercation had taken place between the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail in connection with Kudra P.S. Case No. 08 of 2015 pending in the court of Chief Judicial Magistrate, Bhabua,
Patna High Court Cr.Misc. No.11953 of 2015 (2) dt.27-03-2015 Kaimur stands rejected.
However, it is made clear that if petitioners surrender before the concerned court within four weeks from today and seek regular bail, the prayer for regular bail of the petitioners shall be considered on its own merit without being prejudiced by this rejection order, particularly, keeping in mind the specific accusation levelled against each accused as well as injuries sustained by the injured and furthermore, taking note of this fact that there is case and counter case between the parties and the alleged occurrence is said to have taken place on account of land dispute.
