JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code. The prosecution case is that petitioner No. 1 Vijay Kumar Singh assaulted with sword to the wife of the informant whereas petitioner No. 1 Aman Chouhan assaulted with sword to the informant. Co-accused Narayan Singh and Chunmun Singh assaulted on the head of the informant with sword. Petitioner Nos. 3 and 4 are alleged to be the order givers.
It is submitted by learned counsel for the petitioners that injuries of the informant and informant's wife have been found to be simple in nature caused by hard and blunt substance when there is accusation of making assault by
Patna High Court Cr.Misc. No.6549 of 2016 (2) dt.11-02-2016 2/2 sharp cutting weapons. There is counter version of the occurrence also and petitioners' side also received injuries. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Revilganj P.S. Case No. 221 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
