JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is accused in connection with Kotwali P.S. Case No. 132 of 2016 (S.T. No. 279 of 2016), registered under Sections 25(1-B)a, 26(1)(2) of the Arms Act, pending in the court of 5th Additional Sessions Judge, Munger. The accusation is of recovery of three pistols along with three live cartridges from possession of the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 11.05.2016.
Learned A.P.P. opposed the prayer for bail of the petitioner with submission that he is also accused in similar nature of case.
Patna High Court Cr.Misc. No.6195 of 2017 (2) dt.07-03-2017 Having considered the facts and circumstances of the case and the nature of offence, I am not inclined to grant bail to the petitioner for the present. Accordingly, his prayer for grant of bail stands rejected.
