The petitioner seeks bail in Muffasil P.S. Case No. 26 of 2017 under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. 42 sachets of Nepali liquor each containing 180 ML is said to have been recovered from the possession of the petitioner and one another for that the petitioner is in jail since 20.02.2017.
It is submitted by learned counsel for the petitioner that petitioner has remained in jail for about two months for recovery of about 7 litres of Nepali liquor. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named
Patna High Court Cr.Misc. No.14899 of 2017 (2) dt.19-04-2017 2/2 petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Muffasil P.S. Case No. 26 of 2017.
