JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Mahila Bettiah P.S. Case No. 16 of 2019 for the offence under Section 341, 323, 504, 506, 498A and 313 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act. Allegation against the petitioner is that the petitioner and his family torture the informant in connection with fulfillment of demand of dowry. In the instant case marriage took place in 2015.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is ready to keep his wife with full honour and dignity.

No.9935 of 2020(2) dt.29-02-2020 2/2 Considering the statement made in para 12 of the petition, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four weeks from today, on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Mahila Bettiah P.S. Case No. 16 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

After release the petitioner shall be under obligation to keep his wife with full care, honour and dignity and in the event of any complaint as to neglect, misbehaviour or torture by the informant of this case, the Court below shall be at liberty to cancel the bail bond of the petitioner.
