The petitioner apprehends his arrest in Nawada Town P.S. Case No. 468 of 2013, registered for the offences punishable under Section 295A and other Sections of the Indian Penal Code, Sections 3/4 of the Explosive Substances Act and Section 27 of the Arms Act.

Sitaram Pandey the informant made allegation that the petitioner and other accused persons were raising slogans and spreading Communal hatred. Somebody also exploded bombs. Learned counsel for the petitioner submits that 14 persons are named in the FIR. The petitioner's name figured at Serial No. 14 and it is alleged that the petitioner was instigating the mob. Md. Patna High Court Cr.Misc. No.7413 of 2015 (2) dt.23-02-2015 2/2 Babu, Md. Fahim whose names appeared in the FIR have already been granted anticipatory bail vide order passed in Cr. Misc. No. 28814 of 2014 and similarly Md. Sabir Alam and Md. Jawed Akhtar whose names appeared at Serial Nos. 5 and 12 in the FIR against whom there was allegation of firing have already been granted anticipatory bail in Cr. Misc. No. 3015 of 2014. Considering the facts aforesaid and the fact that the case of the petitioner stands on better footing, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 468 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
