1. Heard the learned Advocate for the petitioners and the learned APP for the State.

2. The petitioners seek bail in a case instituted for the offences under Section 30(a) of the Indian Penal Code.

3. The learned counsel for the petitioners has submitted that petitioner no.1 has antecedent of two cases and petitioner no.2 has antecedent of five cases and allegation is of recovery of 189.72 litres of liquor from an auto.

4. The learned counsel for the petitioners submits that petitioners were not arrested from the spot, as such, nothing was recovered from their conscious possession and are not the owner of the seized auto and they came to be implicated at the instance

Patna High Court CR. MISC. No.10660 of 2025(2) dt.05-03-2025 2/2 of Chaukidar with whom they are on an inimical term. It is next submitted that petitioner no.1 is in custody since 25.01.2025 and petitioner is in custody since 30.01.2025. It is also submitted that once an accused is implicated in a case relating to excise the police starts implicating mechanically.

5. Considering the facts afore-stated, the petitioners, above-named, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judgecum- 1st Exclusive Special Excise Court, Saran at Chapra in connection with Bheldi P. S. Case No.68 of 2024.

6. The application stands allowed.
