2. The petitioner apprehends his arrest in a case registered for offence under Sections 341, 323, 324, 307, 504/34, 379 of the Indian Penal Code.
3. As per prosecution case, on 15.06.2023 at about 10 AM, on account of land dispute, all the accused persons including this petitioner came at the door of the informant, armed with various weapons, and started abusing informant. This petitioner is alleged to have assaulted by means of Tengari on the head of informant, whereas co-accused Raghav Kamat snatched gold chain worth Rs. 30,000/- from the informant.
4. It is submitted on behalf of petitioner that petitioner has been falsely implicated due to personal grudge and enmity. As per injury report, Doctor has found two injuries on the head of informant - one lacerated wound over scalp and another swelling over right side orbit region, appears to be simple in
Patna High Court CR. MISC. No.13638 of 2024(4) dt.06-05-2024 2/2 nature. It is further submitted that F.I.R. has been lodged after a delay of six days without there being any plausible explanation of delay. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of injury, delay in lodging F.I.R. and clean antecedent of petitioner, let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Darbhanga in connection with Saketpur P.S. Case No. 55 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
