The petitioners seek regular bail in connection with Excise Case No. 1285 of 2018 arising out of Kaler P.S. Case No. 58 of 2018 for the offences punishable under Sections 30(a), 38(a) of the Bihar Prohibition and Excise Act. The allegation is regarding recovery of huge quantity of illicit foreign liquor from a truck and the petitioner no.1 is said to be the driver of the said vehicle and the petitioner no.2 is said to be the khalasi of the truck.

The learned counsel for the petitioner submits that the said illicit liquor was buried beneath a load of in potato bags and the load was sent

Patna High Court CR. MISC. No.11959 of 2019(2) dt.26-02-2019 2/2 by the cosigner, as such the petitioners did not know that illicit liquor was being carried in the said truck. It is further submitted that the petitioners are having a clean antecedent and are languishing in custody since 29.12.2018.

Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II cum Special Judge Excise, Jehanabad in connection with Excise Case No. 1285 of 2018 arising out of Kaler P.S.
