The petitioner seeks bail in connection with Sahebganj P.S. Case No. 521 of 2019, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The accusation is of recovery of 40 bottles, each containing 180 ML, 13 cartons, each containing 24 bottles of 375 ML, 165 bottles, each containing 750 ML and 12 bottles, each containing 750 ML of Indian made foreign liquor from the court yard of the petitioner and co-accused Uday Tiwari, Deep Prakash @ Chhotu.
Learned counsel for the petitioner submits that it
Patna High Court CR. MISC. No.9873 of 2020(2) dt.28-02-2020 2/2 would appear from the F.I.R. that the alleged bottles of Indian made foreign liquor are said to be recovered from the joint house of the petitioner. The petitioner has no criminal antecedent and he is in custody since 20.01.2020. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Sahebganj P.S.
