This modification application has been preferred on behalf of the petitioner to modify the order dated 24.11.2021 passed in Cr. Rev. No. 86 of 2021.
It is submitted on behalf of the petitioner that the petitioner/opposite party namely Md. Salimuddin filed revision application bearing Cr. Rev. No. 86 of 2021 before this Hon'ble High Court and during pendency of the above revision application the petitioner/opposite party filed an I.A. No. 02 of 2021 for stay of Misc. (Execution) Case No. 19 of 2020 pending before the learned Principal Judge, Family Court, Bhagalpur. Vide order dated 24.11.2021 passed in Cr. Rev. No. 86
Patna High Court CR. MISC. No.24887 of 2023(3) dt.21-06-2023 2/2 of 2021, this Court had stayed the order dated 10.03.2021 passed by the learned Court below.
Having heard learned counsel for the parties and perusing the materials on record, in my considered opinion, it would be just and fair to direct the learned court below to dispose of both the applications pending before it. In such view of the matter, the learned court below is directed to dispose of the Misc. (Execution) Case No. 19 of 2020 and the modification application filed by opposite party no. 1 (husband) within four months from today by a reasoned and speaking order.
Accordingly, this modification application stands disposed of.
