The petitioner is accused in connection with Mahnar P.S. Case No. 285 of 2017, registered under Sections 341, 448, 323, 385, 427 and 506/34 of the Indian Penal Code and Section 17 of the C.L.A, Act.

The accusation is that informant, Dharmendra Kuamr, was present as Manager of TVS Automobile Agency situated at Mandaha Tori Road in the noon of 16.12.2017. At that time, one person came at the agency and handed over a later to him saying that he came on the instruction of Maoist organization and demanded Rs.1,00,000/-. When the informant made protest then he started scuffle with him, in which,

Thereafter, information was given to the Jamdaha Police Station then police came there and caught hold that person, who disclosed his name as Md. Ejaj. On query, another letter was also found from possession of Md. Ejaj, by which, one Apachi motorcycle was demanded from his agency Meera Automobiles, Hajipur Road. On query, apprehended persons also disclosed that he came on the instruction of Moist Munilal Ram(petitioner). Learned counsel for the petitioner submits that the name of the petitioner has surfaced in the confessional statement of co-accused, Md. Ejaj, who was apprehended at the spot. Further submission is that while petitioner is accused in two other cases, but in both cases, he is on bail, as detailed in para 2 of the petition and in the present case, petitioner is in custody since 02.04.2019.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Vaishali at Hajipur, in connection with Mahnar P.S. Case No. 285 of 2017. Out of two sureties, one surety must be the close

If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
