JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

It is alleged in the First Information Report that the petitioner asked the driver of the vehicle to crush the father of the Informant by a DCM vehicle on which cows were being carried. Mr. N.K.Agrwaral, learned senior counsel appearing on behalf of the petitioner has submitted, referring to the First Information Report, that the allegation as made in the First Information Report is highly improbable and it was a mere case of accident leading to death of informant's father. In view of the submission as above, let above named petitioner in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri A.K.Mall, learned Judicial Magistrate Ist Class, Gopalganj in Kateya P.S. Case No. 217 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
