Petitioner seeks bail in a case registered for the offences punishable under Sections 379/420 of the Indian Penal Code.

The FIR is against unknown. Allegation is of exchange of ATM card. The recovery of ATM etc. is from the possession of co-accused, Awadhesh Rajbhar.

Submission of the petitioner is that nothing of the present FIR has been recovered from possession of this petitioner. Learned counsel for the informant opposed the prayer for bail on the ground that from possession of this petitioner 23 ATM cards were recovered, though not of the present case.

Patna High Court Cr.Misc. No.10357 of 2017 (2) dt.18-03-2017 2/2 Petitioner is in custody since 30.11.2016.

Considering the nature of allegation and period already undergone by the petitioner, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar/successor Court in connection with Buxar Town Police Station Case No. 453 of 2016.
