JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-02-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Udakishunganj P.S. Case No. 102 of 2015, disclosing offences under Sections 341,323,379,353,504/34 of the Indian Penal Code. Petitioner No.1 is the husband of one Nitu Kumari, Headmistress of Primary Middle School, Raghuvarganj.

Petitioner No.2 is the son of petitioner No.1. The informant of the case is Junior Engineer, Udakishunganj Block. It is the case of the prosecution that in course of a meeting held under the Chairmanship of the BEO, Udakishunganj, the said Nitu Kumari was demanding last installment of money

which was allocated for construction of the building of the School. Her request was refused on the ground of poor construction. Thereafter, she allegedly called her husband and son who abused the informant and assaulted him.

Learned counsel for the petitioners submits that the case of the prosecution is apparently malicious and has drawn my attention to an order, dated 19.01.2016, whereby the said Nitu Kumari has been granted bail by this Court passed in Cr. Misc. No. 3001 of 2016.

Considering the submissions advanced on behalf of the petitioners, this application is allowed.

Let the above-named petitioners in the event of their arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Udakishunganj(Madhepura) in connection with Udakishunganj P.S. Case No. 102 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to
