JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 This is an application for grant of anticipatory bail in connection with Sheikhpura (Mahila) P.S. Case No. 61 of 2018, disclosing offences under Sections 498A, 406/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner, who happens to be the husband of the informant, subjecting the informant to cruelty and harassment.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the informant has never came to the house of the petitioner and not married with the petitioner, rather the informant filed a case for divorce before the Principal Judge, Seikhpura, which he has stated in the oath in the supplementary affidavit and the petitioner is a C.R.P.F. employee.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sheikhpura, in connection with Sheikhpura (Mahila) P.S. Case No. 61 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
