JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 04-02-2017 Heard learned counsel for the petitioners and learned counsel representing the State.
The petitioners apprehend their arrest in connection with Adapur P.S. Case No. 163 of 2016, registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.
Allegedly, Shobha Devi the daughter of the informant died and after hatching up a conspiracy the petitioners and Motilal Bind killed her and kept the dead body in paddy field 1000 yards south to the house of his daughter. Submission is of false implication and that the
Patna High Court Cr.Misc. No.1263 of 2017 (3) dt.04-02-2017 2/2 petitioners are father-in-law, mother-in-law and sister-in-law, they have got no concerned from the occurrence. The informant after knowing the reality has filed the compromise petition in the court of Additional Sessions Judge 9th, East Champaran, Motihari in A.B.P. No. 2618 of 2016 stating innocence of the petitioners and, as such, the petitioners deserve sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.
In the facts and circumstances as stated above, considering that the informant is retracting from his earlier version and, as such, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Raxaul at Motihari, East Champaran, in connection with Adapur P.S. Case No. 163 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
