In this case, the petitioner is seeking anticipatory bail in connection with Shekhopur Sarai P.S. Case No.77 of 2017 (POCSO Case No. 29 of 2017) registered for the offence punishable under Sections 363, 366(A), 34 of the Indian Penal Code and Section 8 of POCSO Act.

Allegation has been made that the petitioner has abducted the daughter of the informant for the purpose of marriage with the help of some villagers, but from the order of Ist Additional District and Sessions Judge, it appears that father of this girl wanted to have the marriage with 60 years old man on the consideration amount of Rs.70,000/-. The statement

Patna High Court Cr.Misc. No.11048 of 2019(2) dt.25-02-2019 2/2 under Section 164 of the Code of Criminal Procedure shows that the victim girl has gone of her own volition and entered into the marriage at Harihar Dham.

Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the 1st Additional District and Sessions Judge, Sheikhpura, in connection with Shekhopur Sarai P.S. Case no.77 of 2017 (POCSO Case No. 29 of 2017), subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
