The petitioner seeks bail in Nawada Mahila P.S. Case No. 11 of 2020, registered for the offence punishable under Sections 376, 420 and other allied sections of the Indian Penal Code.

Earlier the bail application of petitioner was rejected vide order dated 31.08.2021. Vide order dated 20.04.2022, report was called for regarding the stage of trial and same has been received, which reveals that charge has already been framed and case is at the stage of prosecution evidence and out of ten chargesheeted witnesses, one witness (victim) has already been examined.

Considering the nature of accusation and stage of

Patna High Court CR. MISC. No.12252 of 2022(4) dt.22-06-2022 2/2 trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

However, trial court is directed to conclude the trial preferably within a period of twelve months from the date of receipt/production of a copy of this order.
