The petitioners seek anticipatory bail in connection with Katoria P.S. Case No. 134 of 2013 registered for the offences punishable under sections 147, 148, 149, 341, 323, 324, 307, 379 and 477 of the Indian Penal Code.

It has been contended that save and except sections 307 and 379 of the Indian Penal Code, all other sections are bailable in nature. The injury reports would suggest that most of the injuries are simple and superficial in nature. It has further been contended that another co-accused, namely, Pappu Yadav against whom there is more serious allegation than the petitioners has

Patna High Court Cr.Misc. No.15284 of 2015 (3) dt.23-07-2015 2/2 already been granted anticipatory bail by a Bench of this Court vide order dated 09.07.2015 passed in Cr.Misc. No. 23915 of 2015.

Learned counsel for the State has opposed the prayer for bail.

Regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within six weeks from today, the petitioners, namely, Buddhu Mahto @ Budhu Yadav, Geniya Devi and Raj Kumar Yadav are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Katoria P.S. Case No. 134 of 2013, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
