JUSTICE BIRENDRA KUMAR ORAL ORDER 25-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 374 of the Indian Penal Code and Section 26 of the Juvenile Justice (Care and Protection of Children) Act.

The petitioner is in custody since 30.01.2017 with allegation that he was carrying the minor boys for the purpose of employing them in labour work.

Submission of the petitioner is that the children were going to their relations along with the petitioner and not for any labour work.

Considering the aforesaid facts as well as the

Patna High Court Cr.Misc. No.18474 of 2017 (2) dt.25-04-2017 2/2 period already undergone by the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Gaya/Successor Court, in connection with Sasaram Rail P.S. Case No.8 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
