2. The present application is for grant of anticipatory bail, in connection with Mirganj P.S. Case No.60 of 2024 for offences under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It would appear from the First Information Report, along with the seizure list, that upon secret information received by the Police, a raid was conducted and three persons were found fleeing away on a motorcycle. It has further been alleged that upon chase by the Police, the three persons, however, left their motorcycle, from which a recovery of 63 litres of countrymade liquor was made. Upon perusal of the FIR, it would also transpire that the secret information

Patna High Court CR. MISC. No.11205 of 2025(2) dt.26-03-2025 2/3 related to one Bhola Yadav, Pankaj Yadav and Manjit Manjhi against whom it is said that they fled away from the place of occurrence.

Learned counsel for the petitioner has submitted that, so far as the petitioner is concerned, he is neither named in the FIR nor has anything to do with the alleged recovery of the country-made liquor. The name of the petitioner has transpired during the course of investigation on the basis of a fact that one of the motorcycles belonged to him, with regard to which the petitioner has stated in paragraph 8, he had given the same to the accused, Bhola Yadav, on his request for attending marriage ceremony of his relative. It has also been submitted that the petitioner has no criminal antecedent.

Considering the above facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of ADJ-IV-cum-Spl. Judge Excise Court, No.11, Gopalganj, in connection with Mirganj P.S. Case No.60 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure/Section 482 (2) of the B.N.S.S.,
