The petitioner seeks bail in Hisua P.S. Case No. 53 of 2021, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner is said to have assaulted Subodh Yadav with Bhala (Spear) causing injury on his head and his tooth also got broken.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. There is general and omnibus allegation. The present case is counter blast of Hisua PS Case No. 44 of 2021 which was lodged on 23.01.2021 and the present case was lodged on 26.01.2021. Both sides sustained injuries. Petitioner claims clean antecedent and he is in custody since 12.08.2021. Investigation is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Hisua P.S. Case No. 53 of 2021.
