Petitioner seeks bail in Chhatauni P.S. Case No.296 of 2019 registered under Section 392 of the IPC. The informant lodged the case against unknown persons for robbing his vehicle.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. During course of investigation, the name of the petitioner figured in the case in the confessional statement of Vikash Kumar @ Manish in para 48 of the case-diary and thereafter the number plates of the vehicle in question and others were recovered from the house of the petitioner. The petitioner was not put on T.I.P. and there is no material to show the involvement of the petitioner in robbery of the vehicle. The petitioner is in jail since 18.12.2019. The

Patna High Court CR. MISC. No.9536 of 2020(3) dt.01-06-2020 2/2 petitioner has already remained in jail for more than five months and he has not been put on T.I.P.

Having considered the facts aforesaid, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Chhatauni P.S. Case No.296 of 2019.
