2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 385 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, petitioner No. 1 caused fire arms injury to one Md. Arsad Alam and petitioner Nos. 2 and 3 are alleged to have assaulted him and others by means of lathi, fists and slaps due to non-fulfillment of demand of extortion. Injury allegedly caused by petitioner Nos. 2 and 3 are

Patna High Court CR. MISC. No.16560 of 2024(3) dt.18-04-2024 2/2 simple in nature.

4. Considering the fact that petitioner No. 1 caused fire arms injury, prayer for anticipatory bail of petitioner No. 1 is refused. However, considering the simple nature of injury, the anticipatory bail with regard to petitioner Nos. 2 and 3 is allowed and it is ordered that the above named petitioner Nos. 2 and 3 in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Naugachia in connection with Bihpur P. S. Case No. 336 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
