Petitioners apprehend their arrest in connection with Mufassil P.S. Case no. 329/2013 registered under sections 307, 379 and other allied sections of the IPC.
According to the prosecution case itself, alleged occurrence took place on account of land dispute and there is specific allegation against Serajul Ansari who is said to have given Bhala blow causing injury on the head of informant and furthermore, it is alleged that petitioner no.1 assaulted by Farsa to injured Raju Singh. Annexure 2/1 to this petition reveals that injured Raju Singh sustained four injuries but all the injuries were caused by hard and blunt substance
Patna High Court Cr.Misc. No.8595 of 2015 (2) dt.04-03-2015 and opinion regarding one injury which was found on the retina of the eye of injured was kept reserved. Moreover, rest injuries were found simple in nature.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in Mufassil P.S.
