2. The petitioner is apprehending arrest in connection with Karja P.S. Case No. 112 of 2024 instituted under Sections 147, 148, 149, 341, 324, 307, 379, 354, 427, 504, 506 of the Indian Penal Code lodged on 08.05.2024 by the informant, Raju Kumar Yadav.

3. As per the prosecution story, the informant alleged that the accused armed variously came and the allegation against this petitioner is that after abuse, he gave iron rod blow on the hand of the informant causing fracture. Mithilesh Rai gave sword blow on the head whereafter, he became unconscious. Later, allegation of assault is also on his brother and father which led to the FIR after they were shifted at SKMCH, Muzaffarpur in a precarious condition.

4. Learned counsel for the petitioner submits that there is case and counter case, both sides have suffered and in the injury is not on the vital part.

5. Learned APP Mr. Jitendra Kumar Singh has taken this Court to the learned Sessions Judge's order to show that there is fracture in the hand and the same has been found to be grievous in nature.

6. Considering the submissions of the parties as also that there is direct allegation on the petitioner of assaulting by iron rod which caused fracture and the same has been found to be grievous, in that back ground, no relief can be extended to the petitioner.

7. The anticipatory bail application stands rejected. (Rajiv Roy, J) Ravi/- U T
