JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in connection with Jamalpur Rail P.S. Case No.48/05 registered under Sections 147, 148, 149, 323, 307, 224, 225, 353 of I.P.C. and Section 174 of Railway Act.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the name of the petitioner has been disclosed by co-accused who is said to have been apprehended in the bogy of the train. Further submission is that while the petitioner is accused in Jamalpur Rail P.S. Case No.41/02 in which he is on bail and petitioner is in custody in present case since 4.1.2017.
