The petitioner seeks bail in connection with Shankarpur P.S. Case No. 100 of 2019, registered under Section 365/34 of the Indian Penal Code.

The accusation is that son of the informant had gone to purchase medicine in the medicine shop situated in the village and the informant also proceeded behind him then saw that Pankaj Yadav, Pravesh Yadav @ Farsha Yadav (Petitioner) and Roshan Yadav forcible boarded his son in the four wheeler and proceeded towards Saharsha. The informant made query from father of Pankaj Yadav, but he did not give any reply to him. Learned counsel for the petitioner submits that petitioner and informant are co-villagers and he has falsely been implicated in this case mere on suspicion. Further submission is that when son of the informant returned to his house then on the suggestion of the informant, he gave his statement under Section 164 Cr.P.C. about his kidnapping by the petitioner and other named in the F.I.R. for the purpose of performing marriage forcibly and confining him in a house. Further submission is that petitioner has no criminal antecedent and he is in custody since 28.11.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Madhepura in connection with Shankarpur P.S. Case No. 100 of 2019.
