The petitioner seeks bail in Karai Parsurai P.S. case No. 100 of 2015 under Section 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

The informant alleged that she was some talk with her husband but her father-in-law came and took her husband outside the house. After some time her husband returned. Her father-in-law, the petitioner, again came to the room of house and shot her husband dead.

The learned counsel for the petitioner submits that petitioner has falsely been implicated in the case on account of land dispute. The story, as disclosed by the informant, is not

Patna High Court Cr.Misc. No.11019 of 2017 (3) dt.08-04-2017 2/2 believable as the deceased was own son of the petitioner. On the other hand the learned counsel for the informant as well as the learned Additional Public Prosecutor opposed the prayer for bail.

There is specific allegation against the petitioner that he shot his son dead.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
