The petitioner seeks bail in connection with Baheri P.S. Case No.270 of 2015 registered under Sections 302, 386, 387 and 120(B)/34 of the Indian Penal Code besides Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. rather the name of the petitioner has come in this case, in course of investigation, in the confessional statement of the co-accused Rishi Jha, Munni Devi and Anchal Jha. Thereafter, the petitioner has been remanded in this case on 03.08.2016 as he was in
Patna High Court Cr.Misc. No.7325 of 2017 (2) dt.10-03-2017 2/2 custody in connection with Baheri P.S. Case No.51 of 2016. It is submitted at the Bar that while the petitioner is accused in four other cases, as detailed in paragraph-3 to this application, but out of the aforesaid four cases, he is on bail in three cases except Baheri P.S. Case No.51 of 2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Baheri P.S. Case No.270 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
