Having regard to the nature of allegation for offence under Sections 147, 148, 149, 341, 323, 324, 504, 506, 379, 385 &
Patna High Court Cr.Misc. No.17068 of 2015 (5) dt.17-08-2015 307 of the Indian Penal Code and Section 27 of the Arms Act, this Court, taking into account the statement of the eye-witness supporting the occurrence to the extent of there being exchange of blows of fire-arms and that the Superintendent of Police in course of supervision, on the basis of statement of the witnesses, had found the allegation made against the petitioners to be substantiated, this Court will not be inclined to grant privilege of anticipatory bail to the petitioners only because there was an abrasion in the scrotum of the informant or that there was an old land dispute having been supported by the oral statement of many witnesses.
Accordingly, the prayer for anticipatory bail of the petitioners, namely, Rajesh Mandal, Pravesh Mandal, Narayan Mandal, Manjhi Mandal and Ranjeet Mandal (all petitioners of Cr. Misc. No. 17068 of 2015) and Ranjit Mandal (petitioner of Cr. Misc. No. 17394 of 2015) is hereby rejected but, nothing said in this order shall stand in the way of the petitioners in surrendering before the court below and making prayer for regular bail which shall be considered on its own merit without being prejudiced this order.
