JUSTICE ARVIND SRIVASTAVA ORAL ORDER 30-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner is accused in connection with Sanhaulla P.S. Case No. 130 of 2016 registered under Sections 302, 120B, 34 of the I.P.C. and 27 of the Arms Act.

Submission of learned counsel for the petitioner is that similarly situated co-accused person namely, Amar Kumar @ Amar Mandal has already been allowed bail by this Court vide Cr. Misc. No. 16020 of 2017 on 13.10.2017. Further submission is that petitioner was accused in one another case, in which he is already on bail and in this case, petitioner is in custody since 17.12.2016.

Having considered the above facts and circumstances

Patna High Court Cr.Misc. No.17704 of 2017 (7) dt.30-10-2017 2/2 of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 5th Additional Chief Judicial Magistrate, Bhagalpur in connection with Sanhaulla P.S. Case No. 130 of 2016.
